  • A company specialized in developing and operating smart phone applications. The (Vizage) platform, which includes the (Vizage Business) application for the service provider, the (Vizage App) for the customer, and the website, is one of the company's projects (products)
  • The company's main headquarters is in Taif, within the Makkah Al-Mukarramah region, with branches in Makkah Al-Mukarramah and Alexandria, Egypt.

Visage platform

  • Vizage Business application for the second party (service provider), which is intended for salons and beauty experts, through which they can display services, images and prices.
  • Visage App for the third party (the client) who wants to book beauty services from the second party.

What does (Visage) platform offer?

  • Vizage provides a mediation service by enabling the second party (the service provider) to display the beauty services it provides through the (Vizage Business) application, and enables the second party (the client) to book the beauty service through the (Vizage App) in the Kingdom of Saudi Arabia.

Who are the users of (Visage)?

Restricted to females and girls aged (18) years and above.

The application clients are the second party (the service provider) and the third party (the customer) requesting the service.

agreement (contract)

The contract governs the terms and conditions for utilizing the (Visage) platform, encompassing both the applications and the website.

Deposit

It is a percentage deducted from the reservation amount to ensure commitment from both the client and the service provider. It should not be less than (10%) and may increase according to each service provider's policy. This percentage is collected through electronic payment via the application, which is the only means to confirm the reservation.

Terms and Conditions Agreement

The parties in this agreement (contract)

The first party:
Referred to in this agreement as the (Visage) platform, it is the Digital Core Trading and Marketing Company that developed and owns the intermediate platform between the second party and the third party.

The second party:
Referred to in this agreement as the (service provider), it includes any salon or beauty expert who has created an account on the Visage Business application to be able to showcase the beauty services they offer to the third party. These services include makeup, hair services, body care, nail services, massage and spa services, eyelashes and eyebrows, as well as henna and tattoo services. The second party is responsible for setting prices, locations, service execution times, and displaying photos of the services and the employees who provide them.

The third party"
Referred to in this agreement as the (client), they are the service seeker who wishes to book a beauty service or services offered by the second party through the client's application.

The degree of enforceability of the agreement (contract)

This agreement is considered a formal and binding contract for anyone using the (Visage) platform. The use of the platform constitutes implicit agreement to all the terms and conditions stated in it without exception.

In the event that you do not agree to any of the provisions of this agreement, you must not use the (Visage) platform, whether (applications or website).

The duration of the agreement (contract)

This agreement (contract) is ongoing and not bound by a specific duration, as long as the first party continues to provide the intermediary service and the second and third parties continue to use the platform.

How the agreement (contract) is brought to a close

The first party has the right to terminate this agreement (contract) with the users by disabling their account in the event of justified reasons, without prior notice.

Users have the right to terminate this agreement (contract) with the first party by uninstalling the application from their device without prior notice.

About the agreement's issuance

The initial version of the Terms and Conditions Agreement for (Visage) platform was issued on May 1, 2023.

This agreement is valid from the date of its issuance.

This document bears version number (23.5.15.51.206).

Updating the versions of the agreement

The Terms and Conditions agreement is subject to periodic updates by the first party (including additions, modifications, and deletions) at any time as deemed necessary, without prior notice.

The first party reserves the right to update the agreement, and the second and third party are obligated to comply with the updated or modified terms and conditions each time the platform is used.

The second party and third party are required to regularly visit this page to stay updated on any updates or changes to the Terms and Conditions Agreement.

The law governing this agreement

This agreement is subject to all applicable governmental regulations in the Kingdom of Saudi Arabia.

Reservation Policies

Types of reservations

(Classic reservation) is a type of reservation that is made automatically. The client creates it and selects it based on the available time slots in the schedule of the service provider, which are displayed to them in the client's application through the available search filters.

(Express reservation) is a type of reservation that the client creates by submitting a request for a quick service. This request includes the service name, appointment date, and location. If the service provider is interested, she can immediately provide an offer to the client, including availability and price. The client then receives offers from available service providers who are ready to accept the reservation.

(Out App reservation) is a type of reservation created by the service provider manually adding it to their main page through the "Add External Reservation" icon. This is done based on available time slots for requests received from outside the application, such as through their social media accounts, messages, or calls. The purpose is to manage reservations and prevent conflicts.

The method of confirming the reservation

The reservation is not considered confirmed unless the client pays the deposit according to the policy of each service provider using one of the approved electronic payment methods in the application.

Delayed payment of the deposit may result in the loss of the same reservation to another client who has chosen the same options and paid the deposit more quickly.

Financial Policies

Deposit

Paying a portion of the booking value, which is a minimum of 10%, is the only way to confirm the reservation.

The percentage of the deposit varies from one service provider to another according to the policy of the second party (service provider).

The status of the deposit remains pending with the first party until the completion of the reservation.

After receiving a confirmation notification of the reservation execution from the second party and a confirmation notification of execution from the third party, financial procedures for each transaction are initiated independently.

The remaining amount of the booking value

The second party (service provider) is responsible for collecting the remaining amount of the booking value from the third party (client) in the manner determined by them, without any liability on the first party.

Commission of the first party

The first party is entitled to a symbolic commission of 4.5% of the total value of each booking transaction.

The commission of the first party is deducted only from the deposit.

The financial management of the first party is responsible for calculating and consolidating the dues of both parties, and transferring the dues of the second party, after deducting the commission of the first party, from the total amount of deposits from all booking transactions, once, to the bank account of the second party at the beginning of each Gregorian month, within (5) working days.

The financial management compiles a monthly summary and dues report for both parties, which is sent to the second party via email at the end of each calendar month.

The application is free for the third party according to the current policy of the first party.

The payments

The first party relies on electronic banking transactions and bank accounts for the payment or collection of obligations between the two parties.

Visage payment management relies on a secure online payment policy through the application, using officially authorized payment gateways by the Saudi Central Bank.

Financial compensations

The first party bears the responsibility for any error caused in favor of the affected party, with a financial compensation not exceeding 200 Saudi Riyals only.

The second party (service provider) is responsible for refunding any amounts collected from the client and all fees associated with the cancellation of the confirmed reservation by deducting them automatically from the value of the deposit for the nearest booking made through the application.

The third party (the client) is responsible for all fees associated with the cancellation of the confirmed reservation, after deducting the specified percentage according to the cancellation policy by automatically deducting them from the pending deposit amount.

Cases where no compensation is provided

The first party is not liable for any compensation in case the users do not comply with the terms and conditions of this agreement.

Cash refund

If the customer refuses the alternative solutions offered, the policy followed by the first party is to refund the deposit to the customer's wallet within the application.

If the customer decides to receive the financial refunds to their bank account, the financial management of the first party will handle the refund process. Refund requests may take a maximum of 15 business days, excluding official holidays, and the customer will bear all administrative and banking fees associated with the refund process.

Invoices and payment receipts

The first party provides users with online receipts and invoices for all financial transactions through the application and via the registered email address associated with their account.

The first party reserves the right to modify or update the financial policy in the future, in order to achieve its interests and support continuity, without prior notice.

Customer ratings for the first party on the online store are based on the operating system used by each customer.

The second party's (service provider) rating of the third party (client) and vice versa.

Account Management Policy

Inactive Accounts

If more than (90) days have passed since the last transaction, the account will be classified as inactive.

If more than (120) days have passed since the last transaction, the account will be classified as non-active.

If more than (180) days have passed since the last transaction, the account will be automatically deleted from the system without any responsibility on the application management.

Inactive Accounts

The first party reserves the right to manage, monitor, edit, or remove any comment that violates its objectives, terms, and provisions stated in this agreement.

The first party provides a professional and qualified team to handle inquiries and issues faced by customers.

Live chat within the application.

WhatsApp messaging.

Email communication.

Phone calls.

Types of communication

Complaints:

Any request sent by customers/users expressing their dissatisfaction with the booking and related matters.

Suggestions:

Any request sent by customers/users that includes implementing new and developmental ideas that bring positive results to Visage.

Inquiries:

Any request sent by customers/users inquiring about the functioning of a particular service.

Each request is assigned a unique ticket number.

The dedicated team with the first party takes care of reviewing the request.

The request is processed, and a ticket is sent to confirm the request processing and close the ticket.

Obligations of the Parties to the Agreement

Obligations of the first party

Safeguarding the privacy and ensuring the confidentiality and security of user information, protecting it from hacking, viruses, and other malicious software through full encryption.

Regularly updating and developing the applications as needed.

Adopting and implementing feasible improvement suggestions to enhance the quality of the applications and meet user expectations.

Effectively promoting the applications to fulfill the users' expectations.

Designing and continuously updating the terms and conditions to ensure the rights of all parties in this agreement.

Implementing all necessary financial procedures to ensure the availability and secure functioning of the payment gateway at all times.

Obligations of the second party

Ensuring the accuracy of all information related to the services, such as service names, service images, prices, service execution time and location, offers and discounts, features, alerts, service availability, mandatory deposit percentage, and other relevant information.

Providing competitive pricing for Visage applications and periodic offers and discounts.

Ensuring the availability of the services offered in the applications.

Uploading legally and socially acceptable images of the services to the target audience, and regularly updating the displayed service images to ensure continuous bookings.

Adding externally made bookings to the booking schedule continuously and permanently to prevent conflicts in bookings.

Managing the time slots accurately and closing them if unable to accept bookings during a specific time of day, month, or year.

Sending confirmation notifications for executed bookings.

Rating the customer after executing the booking.

Using genuine, approved, non-harmful, and non-counterfeit materials and products.

Implementing precautionary measures, using clean and sanitized tools to ensure customer safety.

Compensating the third party if they suffer any harm (health, psychological, or material) due to negligence, misuse, or provision of incorrect information during the execution of the booking.

Not performing any service that is explicitly prohibited by Islamic law with no dispute.

Not using tools or equipment that are prohibited religiously or legally.

Communicating with the customer before the scheduled booking time with sufficient time to inform about any urgent delays, and committing to rescheduling the appointment according to the customer's availability if they still wish to proceed with the booking.

Collecting the remaining amount of the booking value directly from the third party (the customer) using the appropriate method determined by the second party, without any liability on the first party.

Obligations of the third party

Ensuring the accuracy of booking details before completing the process.

Disclosing and informing the service provider of any pre-existing or anticipated health issues prior to the execution of the booking, such as skin allergies, nasal or eye allergies, or chest allergies.

Confirming the execution of the booking after receiving the service in full.

Evaluating the service(s) after the execution of the booking.

Evaluating the service provider after the execution of the booking.

Reviewing the booking request before finalizing and confirming it.

Not requesting any service that is explicitly prohibited by religious law without any dispute on that matter.

Providing the correct address for home services to the service provider.

Ensuring a suitable and safe location that guarantees the safety, dignity, and modesty of the service provider.

Communicating with the service provider in advance of the scheduled execution time to inform about any unforeseen delays, and rescheduling the appointment requires the agreement of the service provider based on their availability.

Directly paying the remaining amount of the booking to the service provider using the appropriate method determined by the second party without any responsibility on the first party.

Disclaimer Policy

Disclaimer of liability for the first party (Visage) platform

The first party does not interfere in determining the services, their prices, the place of execution, the offers, the displayed images, or any other aspect presented by the service provider in the client's application.

The first party is not responsible for the quality and level of services provided to clients by registered service providers in the Vizage Business application.

The first party is not responsible for any errors or negligence committed by the second party, its employees, or those working with it in the service provided to the third party, or vice versa.

The first party is not responsible for accepting, rejecting, or canceling a reservation unless requested by a user through communication with customer service, according to the applicable policy.

The first party is not responsible for the user login information if it is shared with someone other than the account owner, and any damage resulting from that will be the responsibility of the person who shared their information.

The first party is not responsible for any harm caused to the third party as a result of the execution of a permissible service from a Sharia perspective, but due to poor execution by the second party that falls within the scope of prohibited actions according to Sharia.

The first party is not responsible for the cancellation of a reservation by the system due to failure to pay the deposit within the specified deadline.

The first party cannot be held responsible for any failure by user clients to receive or act upon notifications within the applications, registered email, or SMS messages pertaining to reservation confirmation, reminders, or emergency modifications.

The first party is not responsible for any claim by a user client who did not read this agreement (terms and conditions).

The first party is not responsible for collecting the remaining amount of the reservation value from the third party, and it is the responsibility of the second party to determine the appropriate method.

The first party is not responsible for customer demands to refund payments due to their dissatisfaction with the service.

Disclaimer of liability for the second party (Service Provider)

The second party is not responsible for any health problems that occur to the third party due to services that were not disclosed before obtaining the service.

The second party is not responsible for the complete cancellation of the reservation, cancellation of some reserved services, or their postponement due to the third party's failure to attend at the specified time.

The second party is not responsible for any errors made by the third party due to any incorrect and inaccurate information in the reservation.

The second party is not liable for the failure of communication before the scheduled execution of the reservation with sufficient time to notify about any unforeseen delays, and rescheduling is subject to the service provider's availability.

The second party is not obliged to agree to perform additional service requests that were not included in the original reservation request, and acceptance or rejection is subject to the service provider's approval.

Disclaimer of liability for the third party (Client)

The third party is not responsible for the delay of the second party in arriving at the scheduled time for executing the reservation.

Visage Platform Rights Policy

Rights and privileges

The right to report any activity that is suspected to be violating the applicable regulations in the Kingdom of Saudi Arabia.

The right to access the second or third party's account and any information therein, and disclose it to government authorities if deemed necessary.

The right to update the terms and conditions agreement (including additions, amendments, and deletions) at any time without prior notice.

The right to update, improve, and develop the applications at any time without prior notice, with no guarantee of being free from errors or issues.

The right to update the displayed beauty service menus (including additions, amendments, and deletions) at any time without prior notice.

The right to permanently or temporarily freeze or delete user accounts at any time without prior notice.

The right to change pricing or add or impose any new fees at any time without prior notice.

Periodic Maintenance Schedules

The first party makes every possible effort to ensure the safety and continuity of the service for users.

In the event of any unforeseen technical malfunction, the first party is not responsible for the unavailability of the application at any time. Access through the application may be temporarily suspended without prior notice until the emergency issue is resolved.

The right to perform scheduled maintenance, and users will be notified in advance of the type, timing, and duration of the necessary periodic maintenance.

Prohibited Uses Policy

Anyone who uses the Vizage platform outside of this designated category.

Anyone engaged in activities that violate any law or regulation in the Kingdom of Saudi Arabia.

Anyone who provides false information during the registration process with the intention of identity theft, fraud, or forgery.

Anyone who is proven to have breached the Vizage platform and disseminated viruses, malicious software, programs, codes, or any other materials with the intention of causing harm.

Anyone who is proven to use Vizage applications with the purpose of theft, harm to others, or unauthorized access to their personal information.

Anyone who is proven to use Vizage applications with the purpose of establishing a competing business.

Anyone who is proven to use Vizage applications with the purpose of copying or transferring its contents without obtaining written consent from the first party.

In the event of any violation (behavioral, ethical, financial, or criminal) between the parties of this agreement, it shall be within the jurisdiction of the governmental authorities in the Kingdom of Saudi Arabia.

Anyone who is proven to impersonate the first party or use the name, logo, or intellectual property without permission.

The uses that necessitate freezing and deleting the account

The actions that require legal accountability will result in the permanent freezing and deletion of the account.

Performing any service that is explicitly prohibited by religious or legal norms.

Using tools that are forbidden both religiously and legally and are unauthorized for use.

Anyone who writes comments that involve any form of abusive language, harassment, hate speech, discriminatory remarks, or violates the privacy and dignity of others.

Anyone who publishes personal information of users, including but not limited to: (phone numbers, personal social media accounts, bank account information, credit card information).

Posting any advertising material without prior agreement with the administration.

Displaying images of services that exceed the allowed limits religiously and culturally within the target audience.

Creating conflicting bookings by the second party (service provider) within a specified period will result in account suspension and removal.

Repeatedly canceling confirmed bookings without proving non-emergency reasons warranting their cancellation.

Intellectual Property Rights

Intellectual Property Rights

The (Visage) platform is a registered trademark owned by the Digital Core Trading and Marketing Company in the Kingdom of Saudi Arabia. It is not permissible for any party to use the trademark in any form (copying, printing, publishing, impersonation, or reuse) without obtaining written consent from the owning company.

Publishing that aims to market (Visage) applications is allowed.
